TERMS AND CONDITIONS

The following Terms and Conditions apply to:
The Artist(s) - PAGE28 and Stephen James

​Please note these terms may by in addition to those booked through an Agency
Alert Level Policy:
If a booking is not able to take place due to a change of alert levels or a State of Emergency, the booking may be rescheduled to a new date up to 18 months from the original date.
If the Artist(s) are able to perform on the new date, the booking will be transferred to this date.
​If the Artist(s) are not able to perform on the new date, a new Artist(s) can be arranged through another agency or the booking is cancelled. 
No cancellation fees or other penalties will be apply.
​Refunds may apply.
Vaccination Status:
All Artists are fully vaccinated against COVID19.
Payment:
Customers will be invoiced from either the Artist(s) or the agency the booking has been made through.
The expectation from the Artist(s) is that payment is paid in full the day before your function.
The Artist(s) do not require a deposit, however cancelation fees will apply.

​Agencies the Artist(s) work through do request deposits or full payment to confirm bookings.
If bookings are made through an Agency and not directly through the Artist(s), additional charges on top of the Artist(s) fee will be added.​
​The Artist(s) have no control over what additional fees Agencies charge clients. 
GST Registered:
We are not GST registered, however some agencies we work with may be GST registered
​Invoices directly from the Artist(s) will not be inclusive of GST.
Setup / Sound Check:
Artist(s) will supply a PA and lighting equipment unless otherwise stipulated at time of your booking.

​Artist(s) PA and lighting systems are included in all costs.


FOR FULL PA AND LIGHTING SET UPS:
The Artist(s) aim to arrive approximately 1 and 1/2 hours before the start time to set up the PA and lighting system.

FOR SMALL PA SET UPS:
The Artist(s) aim to arrive approximately 1 hour before the start time to set up the PA system.

FOR MULTIPLE PA AND LIGHTING SET UPS:
Some weddings have multiple set ups e.g. one area for the ceremony and a different area for the reception.
The Artist(s) aim to arrive approximately 1 and 1/2 hours before the start time to set up.


Arrangements can be made to set up the PA system earlier if this is requested at the time of booking.

PA SYSTEM SUPPLIED BY THE CLIENT:
If a PA system is being supplied by the client, the Artist(s) 
prefers to have a sound check arranged before
the scheduled performance time to get familiar with the gear and sound. 

The Artist(s) require the following gear to be supplied:
* 2 x mics with stands (for duo) - 1 x mic and stand (for solo)
*4 x mono OR 2 x stereo DI boxes (for acoustic or electric guitar and iPad)
Performance / Stage Size:
Ideally we request a minimum space of 2m x 2m to accommodate our
​PA system / lighting gear and performance space.


Pack down:
Gear supplied by the Artist(s) will be packed down immediately after the performance.

Gear supplied by the Artist(s) will not be able to remain onsite for ​collection at another time
​or day due to insurance requirements. ​
Performance Times:
Agreed upon by the Artist(s) and the client at time of booking/confirmation.

Agreed upon by chosen package.

Bookings are based on a maximum of 3 hour performance time with no more than 2 x 15 minute breaks.

Additional performance times can be discussed but further costs will apply.
Additional Performance Times
At the sole discretion of the Artist(s), the client may request additional performance time
​either at time of booking or on the night of their event.
If the artist(s) agrees to perform for an additional time, this will be no longer than 1 hour and
​charged at an additional rate of $150.
Music during breaks:
A playlist will be supplied and played by the Artist(s) during break times.
If particular music is required this needs to be pre-arranged.
Requested Songs for Artist(s) to learn:
Song requests can be made.
Clients must allow 14 days notice.

Songs requested after 14 days notice is at the discretion of the Artist(s).

Song requests are limited to 4 songs for a wedding ceremony and no more than 3 songs for the Reception.

Song requests for other functions are limited to 4 additional songs.
Set Lists:
With the large amount of songs on the Artist(s) profile, set lists can be pre-arranged.
The Artist(s) will ask the client to go through their full 
SONG LIST and cross off the no gos and the Artist(s) will arrange a set list based off this.

Set lists are arranged to suit your function type.

​Song requests from guests can be made, however this is subject to the Artist(s) knowing the song.
Sound Production:
Unless otherwise stated, the Artist(s) will provide their own PA system and Lighting gear.

​Our PA system is not designed for massive scale events.
 
The Artist(s) have the following gear:

1 x Mackie DL806 Digital Mixer
2 x Shure Bata 57a Microphones
2 x Audio technica 3300 Condenser Microphones

3 x iPads for Backing Tracks and Sound Mixing
3 x iPad Stands
20 Meter Extension Cable and Multiple Shorter Extension Cables
All required Cables to run the PA System


Lighting System:
4 x Rotating lights on a stand
2 x Rotating floor lights
2 x Laser lights
4 x Par lights
​Multiple Extra Floor and Stage Lights
Sound Switch Computer Lighting Programme
MacBook Pro to run Lighting System
All required Cables to run the Lighting system

Instruments:
1 x Martin Guitar
1 x Taylor C214 Guitar
1 x Electric Guitar

The Artist(s) gear is safety tested and tagged every 12 months

Required from Venue/Client:
​Plug to plug our system into.

It is the Venue/Clients responsibility to provide power onsite. The Artist(s) do not supply generators.
Meals and Drinks:
Your invoice/contract will indicate if Artist(s) meals are to be provided.

For the Ceremony and Reception Package - meals are required to be provided for the Artist(s).

Non-alcoholic drinks are to be supplied to the Artist(s) by all clients. ​
Breaks:
Bookings are generally based on a maximum of 3 hours performance time with no more than 2 x 15 minutes breaks.
Client Cancellations
In the event of a client cancelling, a cancellation fee may apply.

In the event that the booking is cancelled between 4 weeks and 14 days prior to the booking taking place, the Artist(s) will take reasonable steps to contractually demand 25% payment for the booking from the client.

In the event that the booking is cancelled 14 or less days prior to the booking taking place, the Artist(s) will take reasonable steps to contractually demand 50% payment for the booking from the client.

​Invoices will be issued.
Artist(s) Cancellations:
Cancellations are strongly discouraged and should only take place under extreme circumstances such as a family grievance or serious injury / illness.
Clients will be informed immediately of any issues or changes.
​The Artist(s) will find a suitable replacement.

The Artist(s) reserves the right to cancel a booking at any time if it deems to be unsuitable
​for the event for any reason whatsoever.
Performances:
The Artist(s) must not contain political or offensive material.

The Artist(s) are required to dress to reasonable standards and maintain professional behaviour in ​keeping with the type of event and venue.

The Artist(s) will perform to their highest standard and give a true representation of their recorded material.

The Artist(s) will not drink alcohol excessively before or during the performance or use illegal or banned substances.

At the sole discretion of the Artist(s), the client may request additional performers to join on stage. This is to be pre-arranged.

Unfortunately gear belonging to the Artist(s) can not be used for any other purposes unless prearranged e.g. speeches.

The Artist(s) do not hire out sound and lighting equipment only.
Health & Safety:
The Artist(s) act to recognize and comply with all health and safety contracts. 

The Artist(s) understands their obligations under the Health & Safety at Work Act (2015) and will comply at all times while working on this contract.

All gear is maintained and checked and cables are annually certified.
Payments:
Unless stated otherwise, full payment is required the day before the event.

The Artist(s) undertake to follow up unpaid accounts with due diligence. External collection agencies may be required.

​If client payment is arrange after the event, then payment must be made within 5 working days.
Confidentiality:
For private functions, all details of the booking will be keep confidential. 

For public functions, details will be shared on our website and social media platforms unless stipulated by the client.
Photography/Videography:
The Artist(s) give permission for photos and videos to be taken of their performances
​and shared on social media, YouTube etc.

If photos/videos of the Artist(s) will be used for advertising purposes, then permission needs to be obtain from the Artist(s) or agent.

Any photos/videos of the Artist(s) received from photographers/videographers taken at events, with their permission will be used on our website and social media platforms - photographers/videographers names will be credited. 

The Artist(s) reserves the right to take photos and videos of their own performances for advertising purposes however this will be prearranged with the client. Footage that is taken will not include other visible persons unless permission is granted.
Client Responsibilities:
The Client agrees that it is their responsibility to ensure all relevant music licences, insurance policies and safety tests are obtained before any live music is booked and that there are no volume restrictions at the venue that might prevent the Artist(s) from performing.
Any volume restrictions, time frames are to be made aware to the Artist(s) at the time of the booking.

Client will provide parking facilities suitable for the Artist(s) performing, and easy loading and unloading facilities. 

The Client shall not make or permit the making of any audio and/or visual 
recording or transmission of the Artist(s) performance without the prior written 
consent of the Artist(s).

It is the responsibility of the Client to ensure that the Artist(s) does not suffer any aggressive or abusive behaviour. If the Client is aware of any such behaviour from guests or staff, and that behaviour is allowed to continue, then the Artist(s) may terminate the performance and will still be entitled to their fee, in its entirety.

If the Client or venue provide a stage, it must be of suitable proportions to accommodate the Artist(s).
This stage should be stable, safe and of good quality.

The Client and the Artist(s) agree that the equipment and instruments of each Artist(s) performing at the event are not available for use by any other person except by specific permission of the Artist(s), this includes microphones.

If the Artist(s) is unable to complete their entire performance due to the event running behind schedule or as a result of a restriction placed on their performance on the day from the venue, full payment is still due to the artist.
